Short-term rentals in Portugal: what owners need to understand about AL in 2026
Alojamento Local rules have swung twice in three years. What registration involves now, why the municipality matters more than the national law, and how to underwrite a rental assumption you can defend.

Between 2023 and 2024, Portugal restricted new short-term rental registrations, introduced an extraordinary levy, and then reversed much of it. If your understanding of AL comes from an article written in either of those years, it is probably wrong in one direction or the other. This is a field where you check the current rule for the specific address, in the specific município, on the day.
What AL actually is
Alojamento Local is the legal category for furnished short-stay accommodation. Registration attaches to the property and produces a number that must appear on your listings. It brings obligations that surprise first-time owners: guest reporting to the immigration authority, municipal tourist tax collection where it applies, liability insurance, a complaints book, safety equipment, and the property meeting habitability standards. Income is taxable in Portugal, and if you are American, reportable to the IRS as well.
The municipality is the real gatekeeper
National law sets the frame; local councils decide where AL can grow. Some parishes in Lisbon and Porto have been effectively closed to new registrations in tourist-saturated areas. Coastal municipalities vary widely, and a village twenty minutes from a suspended zone may be entirely open. Never assume the neighbouring town's answer applies to yours.
Apartments: the condomínio problem
In a multi-unit building, the condominium assembly has real power to object to short-term letting in a fraction. Before buying an apartment on a rental thesis, read the minutes of the last three assemblies and the building's regulations. A permitted registration and hostile neighbours is a bad combination.
Underwriting honestly
- Occupancy: model the shoulder and winter months separately. Most Portuguese coastal AL is high season plus a thin tail.
- Costs: management, cleaning, linen, consumables, utilities in summer, platform commission, replacement of soft furnishings on a two-to-three year cycle.
- Taxes: Portuguese income tax on the rental category, IMI, and your US position.
- Wear: guest turnover ages a house far faster than personal use.
- The alternative: a twelve-month tenancy at a lower headline number is often a better risk-adjusted outcome, and a far quieter life.
